Term & Conditions
- By signing this Waiver I warrant and represent that I am the Parent or legal guardian (or have the express consent of such Parent or legal guardian) of the Child named in the above form and I agree to assume the risks of allowing my Child to participate in the activities to be organized by Little Dynamos Pty Ltd at the location determined by Little Dynamos from time to time (Activity Location).
- I understand that Little Dynamos, its owners, officers, employees, staff, contracts, volunteers and other authorized agents and representatives (Personnel) will rely on the representations I have made above and by signing this Waiver.
- In the case of an emergency, I consent to Little Dynamos and their Personnel attending to act for my Child according to their best judgment and transporting my Child to the nearest medical facility. I accept full financial responsibility for any injury that my Child may cause either to themselves or to any other person due to my Child’s negligence or my Child not following the directions of Little Dynamos or its Personnel.
- I acknowledge that physical activity, such as those which my child will engage in with Little Dynamos, may involve risk of physical harm, including personal injury, permanent disability and/or death. Such harm may result from my Child’s actions, or the actions and/or omissions of others.
- I fully indemnify Little Dynamos and each of its Personnel against any and all losses, costs, damages, expenses and liabilities (including legal costs on a full indemnity basis) sustained or incurred by Little Dynamos or any of its Personnel in connection with:
- any claim, action, demand or proceedings (whether based in contract, tort (including negligence) or otherwise by any person in relation to any matter occasioned by my Child;
- any failure by my Child to not follow any directions provided by Little Dynamos or their Personnel; and
- any act or omission of or by my Child at the Activity Location or in the course of any activities organized by Little Dynamos or their Personnel which causes or contributes to personal injury to any person.
- If my Child suffers any harm at the Activity Location I will not hold Little Dynamos or its Personnel legally responsible for any injuries or physical harm that my Child may suffer. I will not commence legal proceedings against Little Dynamos or its Personnel for any claim, action, demand or proceedings that I may have in respect of any injury suffered by my Child.
- I acknowledge that this waiver represents a legal release (to the full extent legally allowable by the laws of Western Australia) and discharge of legal responsibility to Little Dynamos and its Personnel and is provided in consideration for the fees paid to Little Dynamos for the services to be provided.
- I acknowledge that Little Dynamos reserves the right to photograph and/or video my Child whilst in the Activity Location. I understand that such photographs or video footage may be used by Little Dynamos for the sole purpose of promoting Little Dynamos, including through social media. I consent to the use of my Child’s image and waive any rights of compensation (such as royalties) or ownership thereto.
- I confirm that I have read, fully understood and explained to my Child, this waiver prior to signing it and agree that this agreement will be binding on me, my Child and my Child’s heirs, next of kin, executors and administrators. I agree that this waiver shall be governed in all respects by and interpreted in accordance with the laws of Western Australia. I declare that I have provided the information requested to best of my knowledge and have carefully read and understood the conditions above. I understand that by signing this waiver I am waiving valuable legal rights and am indemnifying the parties named in this waver, from any liability as outlined. I am signing this waiver of my own free will.
